Optimal trademark strategy for startups: What, why and when
Based on our years of experience in trademark registration and brand protection services, we have compiled a brief guide for an optimal trademark strategy for emerging companies.
A trademark is valid from the date it is registered or granted by the relevant trademark office. Once your trademark application has successfully gone through the examination process and meets all the necessary requirements, including any opposition period, the trademark office will issue a registration certificate. The validity of your trademark begins from the date of registration mentioned in the certificate.
It's important to note that in some jurisdictions, trademark rights can also be acquired through prior use of the mark in commerce, even without formal registration. This is known as common law trademark rights. However, common law rights are generally limited to the specific geographic areas where the mark has been used and may offer less protection compared to a registered trademark.
